Product Warranty

Effective Aug 15, 2018

Your product warranty is automatically in effect for a period of twelve (12) months from date of purchase. You do not need to register again.

The limited warranty is non-transferable and covers only the original end purchaser. Proof of purchase such as an original or copy of a sales receipt, the original Akoustyx LLC order or invoice number or Akoustyx’s authorized retailer verification is required for warranty service. This limited warranty does not cover products purchased through online auction websites. Online sales auction confirmations are NOT accepted for warranty verification.

Akoustyx LLC, hereinafter called ‘Akoustyx’ warrants our products to be free from defects in workmanship and materials under normal use for a period of twelve (12) months from the original purchase date ("Limited Warranty Period").

The following conditions are NOT covered by this limited warranty;

  1. Normal wear and tear of product usage;
  2. Normal wear and tear of the included accessories;
  3. Misuse, lack of care, mis-handling, accident, abuse or other abnormal use;
  4. Use of the Product other than for its intended purpose;
  5. Damage caused by unauthorized repair or maintenance;
  6. Product and or included accessories have been modified or altered;
  7. Changes in cosmetic appearances of product & accessories through normal usage;
  8. Any product that is not manufactured by Akoustyx (including, without limitation, any non-Akoustyx product that is used in connection with the Product).


Limited Warranty
Akoustyx products are warranted against defects in workmanship and materials for a period of twelve (12) months from the date of original retail purchase from www.akoustyx.com or from an authorized Akoustyx dealer.
If a defect exists, Akoustyx at its option will either (1) repair the product at no charge using the new or reconditioned parts, (2) exchange the product with a functional equivalent product that is new or reconditioned, or (3) refund the original purchase price. We do not cover normal wear and tear, blown speakers, cut cords, bent audio jacks, scratches, stains, loss, or theft.

This warranty excludes damages that come because of abuse, accident, modifications, or other causes that are not defects in the materials or workmanship of the product. Modification or customization of your Akoustyx product will void this warranty.

No other party is authorized to modify this limited warranty. Your dealer is responsible for any additional warranties.

This Warranty gives you specific legal rights, and you may have other rights that vary by state and jurisdiction. These rights shall not be affected by this limited warranty. This warranty cannot be transferred or assigned.


How to Make a Warranty Claim for Service
Proof of purchase is required to verify eligibility (Akoustyx order number or invoice number) of your claim.

Warranty claims for service can be made directly to Akoustyx by contacting the Customer Service at service@akoustyx.com. Akoustyx customer service will verify your purchase on record & provide you with a Return Merchandise Authorization (RMA) number which will be provided to you via email with the return address. Return the item in its original package with all accessories intact to the provided return service center.

Once Akoustyx receives your returned Product, Akoustyx will evaluate your claim (typically within 7-10 business days) to determine whether the returned product is defective. If Akoustyx determines that there are no defects found with your returned product or the returned product does not require any warranty service, Akoustyx will ship the product back to you, at Akoustyx’s expense.

If Akoustyx determines that there is a warranted defect in the product, Akoustyx will, at its option, remedy the defect as set forth below in this limited warranty.
Akoustyx is not liable for products that are damaged or lost in transit to Akoustyx service centers. We recommend that you ship your returned products to Akoustyx via a trackable shipment method. Customers within United States are responsible for shipping costs to Akoustyx service centers. Customers outside the United States are responsible for paying customs fees, including, but not limited to, taxes, duties and brokerage.

All products returned to Akoustyx will be subject to review for authenticity. Products determined to be counterfeit will be confiscated and turned over to Akoustyx's legal department for legal action. Counterfeit products will not be returned & will be destroyed and consumers should seek restitution from their original place of purchase.


Returns for Refund for Non-Defective Product
Product must be returned within thirty (30) days from the date of the original order for a refund.

The following covers the return of non-defective product purchased from the Akoustyx website. Non-defective is defined as any product that does not fall under either:
1. Product that is defective. For defective product, please see our limited warranty.
2. Product purchased from an authorized reseller. Non-defective product must be returned to the original point of purchase. If you purchased a product from Akoustyx through our website, www.akoustyx.com, you may return the product if you are dissatisfied for any reason, and Akoustyx will refund the amount paid for the returned product minus any expedited or international shipping fees.

To expedite your refund, we recommend that you contact customer service by email to service@akoustyx.com & register for a Return Merchandise Authorization (RMA) number which will be provided to you via email with the return address. Return the item in its original package with all accessories intact to the provided return service center. Once Akoustyx receives your returned item, we will check & verify for contents before the process of your refund. Please allow an additional 5 to 7 business days for verification of the returned product.

Akoustyx is not liable for products that are damaged or lost in transit to Akoustyx service centers. We recommend that you ship your returned products to Akoustyx via a trackable shipment method. Customers within United States are responsible for shipping costs to Akoustyx service centers. Customers outside the United States are responsible for paying customs fees, including, but not limited to, taxes, duties and brokerage.

Promptly following Akoustyx's receipt of your returned product (typically within 7 to 10 business days), Akoustyx will credit the amount paid for the returned product (less any shipping costs/expenses related to the original purchase, which are non-refundable) to the credit card you used to make the original purchase. Notwithstanding the foregoing, Akoustyx does not control when a specific credit card company processes a chargeback transaction. You are responsible for contacting your credit card company if you have questions about the status of the chargeback.

Akoustyx will not provide a refund for a non-defective product that is received by Akoustyx more than thirty (30) days after the date of original purchase. Any missing accessories will have the accessory cost deducted from the refund amount for the cost of the missing part plus labor cost to repack the product. Akoustyx also does not provide a refund for returned product that are damaged due to misuse, lack of care, mishandling, accident, abuse or other abnormal use. This non-defective product refund policy applies to the direct end user purchaser only. It does not apply to dealers, distributors or any other third parties in a distribution chain who purchased product for resale or cover products purchased through online auction website or channels other than the official Akoustyx website.


Sole and Exclusive Remedy
Your sole and exclusive remedy for a breach of this limited warranty, and Akoustyx's sole and entire liability is, at Akoustyx's option, to repair or replace the defective product or refund the purchase price of the defective product within 30 days. Repair or replacement (including parts and labor and shipping costs) shall be made at Akoustyx's expense. Akoustyx reserves the right to send you a replacement product that is the same or of a similar style or a substitute equivalent that may not be of like kind (depending on availability). Replacement products will be furnished only on an exchange basis. Replacement products are warranted as above for the remainder of the original applicable product warranty period.


Warranty Disclaimers
EXCEPT AS EXPRESSLY SET FORTH ABOVE IN THIS LIMITED WARRANTY, AKOUSTYX MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES TO THE EXTENT PERMITTED BY LAW AND SPECIFICALLY DISCLAIMS AND EXCLUDES ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF SUCH DISCLAIMER OF ANY IMPLIED WARRANTY IS NOT PERMITTED BY LAW, THE DURATION OF ANY SUCH IMPLIED WARRANTIES IS LIMITED TO THE DURATIONS SET FORTH IN THIS LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, SO SUCH LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROMJURISDICTION TO JURISDICTION.


Limitation of Liability
IN NO EVENT SHALL AKOUSTYX OR ITS SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OF THE PRODUCT, INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, LOSS OF VALUE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE PRODUCT, OR LOSS OF USE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE PRODUCT, EVEN IF AKOUSTYX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AKOUSTYX HAS NO LIABILITY FOR ANY DAMAGE OR DESTRUCTION TO CONSUMER ELECTRONICS DEVICES OR OTHER PERSONAL PROPERTY THAT ARE IN THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, DATA STORAGE DEVICES, LAPTOPS, CELL PHONES, MP3 PLAYERS, DVD PLAYERS OR HANDHELD DEVICES, OR ANY LOSS OF DATA CONTAINED IN THE FOREGOING DEVICES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE LIABILITY OF AKOUSTYX AND ANY OF ITS SUPPLIERS SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT. SOME STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

THIS PRODUCT IS NOT USER SERVICEABLE. THIS WARRANTY IS TERMINATED IF THE PRODUCT OR THE PROVIDED ACCESSORIES ARE MODIFIED IN ANY WAY OR IF THE USER ATTEMPTS TO DISASSEMBLE THIS PRODUCT.
